Gibraltar brought the Proceeds of Crime (Miscellaneous Amendment) Act 2021 into force on 9 February, amending s.61 of the Trustees Act to require all trustees of a Gibraltar trust to obtain current information on settlors, trustees, beneficiaries and protectors and to hold basic information on all entities providing a financial service to the trust. A further amendment ensures that trust flee clauses shall have no effect where they could facilitate a criminal offence or frustrate a criminal investigation. It also substantially amends the Proceeds of Crime Act 2015.
