Following the recent transposition of the EU Fourth Anti-Money Laundering Directive into Irish law, trustees of express trusts are now required to seek professional advice about their duties, to obtain information from beneficial owners of trusts, to establish local registers of beneficial ownership, and to make them available for law enforcement and customer due-diligence purposes.
The regulations also impose specific legislative requirements on the traditionally unregulated and informal procedure for declaring a trust of land.
